Public Hearings

I.          Potential Community Residence Site (cont’d)
1586 West 7th Street
Brooklyn, New York

Community Board 11 has received formal notification of the interest and intent of Program Development Services Inc. under the auspices of the New York State Office of Mental Retardation and Developmental Disabilities to establish a community residence for mentally retarded and developmentally disabled persons at the above address, as provided in Section 41:34 of the Mental Hygiene Law.

Mr. Guarinello advised that since this was a continued public hearing the statements made last month will be part of the record. 

The Chairman inquired if anyone from the public sought to amend or make additional statements. 

Hearing none, a motion was made by Louisa Verito to close the public hearing.  Seconded by Tom Colasanto.  Unanimously adopted.

II.        BSA Application No. 289-58-BZ
David Oil Corp.
398-410 Kings Highway

The applicant seeks an extension of term for a period of 10 years for an existing automotive service station.

The Chairman inquired if anyone from the public sought recognition.  Hearing none, a motion was made by Frank Segreto to close the public hearing.  Seconded by Man Wai Lau.  Unanimously adopted.

Public Portion

Clements Nofi, a resident of West 7th Street, spoke in opposition to the establishment of a community residence for mentally retarded and developmentally disabled persons at 1586 West 7th  Street.  He stated that the house is too small for five people. 

Mr. Guarinello inquired if anyone else from the public sought recognition.  Hearing none, a motion was made by Frank Naccaratto to close the public portion of the meeting.  Seconded by Eileen LaRuffa.  Unanimously adopted.

Minutes

A motion was made by John Raffaele to accept the minutes of the meeting of January 12, 2006.  Seconded by Jerry Chiapetta.  Unanimously adopted. 

Disposition of Public Hearings

Jerry Chiapetta, Chair of the Site Selection Committee, reported that a public hearing was held last month and continued this evening on the proposed community residence site located at 1586 West 7th Street. 

The hearing was continued to afford the residents in the immediate area and the sponsoring agency an opportunity to meet.  The Gravesend Quality of Life hosted the meeting last month at St. Athanasius School.

Mr. Chiapetta advised that under the Padavan Law, the application as presented before Community Board 11 must be approved.

A motion was made by Frank Segreto to approve the potential community residence located at 1586 West 7th Street for five mentally retarded and developmentally disabled persons pursuant to Section 41:34 of the Mental Hygiene Law.  Seconded by Louisa Verito.  Unanimously adopted.

Frank Segreto, Chairman of the Planning and Zoning Committee, reported that the application before Community Board 11 is to extend the variance of the Sunoco Gas Station at 398 Kings Highway for a term of 10 years.  The gas station has had a variance since 1961 and the renewal does not call for any physical changes.

In addition, the applicant’s attorney has provided a “Certification of Inspection and Compliance” which confirms that the premises were developed and operated in accordance with the currently effective BSA approved plans.

A motion was made by Frank Segreto to approve the variance as presented.  Seconded by Man Wai Lau.  Unanimously adopted.

Chairman’s Report

Mr. Guarinello announced that March is Women’s History Month.  In celebration, Senator Golden honors distinguished women in the community.  This year one of the women honored is Marnee Elias-Pavia.  The event will be held on March 16th, at Bay Ridge Manor at 7:30 PM.

Mr. Guarinello advised that copies of the Fiscal Year 2007 Preliminary Budget Register for Community Board 11’s Capital Budget Priorities and Requests are available this evening. 

The Chairman reported that Council Member Vincent Gentile is sponsoring a Child Abduction Prevention Seminar at Tiger Schulmann’s Karate of Bensonhurst located at 8501 New Utrecht Avenue, on Saturday, February 11th from 3:30 – 5:00 PM.  There will also be a Womansafe Self Defense Seminar on Friday, February 10th from 8PM – 10 PM.  Flyers are available for those who are interested in attending.

Mr. Guarinello reminded Board Members who received applications for reappointment to return them as soon as possible to the Borough President’s Office.

District Manager’s Report

Howard Feuer discussed a 421-a partial tax exemption application received from 1562 West 6th Street.  The property before demolition was two one family homes and is now a seven story, 24-unit condominium.  The applicant is seeking approval to HPD for tax abatement. 

A motion was made by Ella Nigro to oppose the application submitted by 1562 West 6th Street for partial tax abatement.  Seconded by Louisa Verito.  Unanimously adopted.

The District Manager advised that the Owl’s Head sewer replacement project is not as extensive as originally presented.  After review of the sewer videotapes, the Department of Environmental Protection determined the sewers need to be cleaned of grease, not replaced.

Mr. Feuer expressed his concerns regarding the amount of sidewalk violations the City issued prior to starting this project.  Almost all of the property owners received summonses along 86th Street.

The District Manager advised that tomorrow he, Assemblyman Abbate and Councilman Recchia will be attending a meeting with the Department of Parks regarding Nelly Bly Park.   The purpose of this meeting is to resolve the issues relating to the RFP that was issued by the Department of Parks.

There was discussion regarding terms of the current lease and the terms for the new operator.

The District Manager discussed an article that was printed in the local papers regarding Carmine Santa Maria receiving a double parking summons on 86th Street. 

Mr. Feuer stated that there were enough meters on 86th Street to prevent double parking and he has requested that the Police Department enforce the meter regulations.  Mr. Feuer was concerned that people are feeding the meters and not moving their cars. 

There was a short discussion regarding the meters on 86th Street.

Mr. Feuer advised that Councilman Gentile requested that Bay 11th Street and 86th Street be renamed in honor of Peter Campisi.  Ella Nigro, Chair of the Parks Committee, reviewed the request and moved the question.  Seconded by Jerry Chiapetta.  Unanimously adopted.

Assemblyman Abbate

Assemblyman Peter Abbate voiced his concerns regarding the newly installed muni-meters.  He stated that areas have lost parking spaces where muni-metered were installed and that the Community Board should monitor this issue.

The Assemblyman advised that he wants to meet the new owners of Nelly Bly.  He stated that the Romano family was very involved with the community and he wanted to ensure that the new owner was community oriented. 

In addition, Assemblyman Abbate was concerned about the amount of money the Department of Parks included in the RFP for improvements.  He did not think that one million dollars was enough money for Nelly Bly to make the improvements that are needed.

New Business

Shirley Fineman announced that COJO of Bensonhurst is sponsoring a rent seminar.  Flyers are available with additional information.

A motion was made by John Raffaele to adjourn.  Seconded by Tony Troia.  Unanimously adopted.
